1. Eligibility: The Corelle® and CorningWare® Nice Serve Contest (the "Contest") (#053) is open to legal residents of the 50 United States and the District of Columbia who are 21 years of age or older as of September 4, 2008. Employees and immediate family members of the sponsors, Every Day with Rachael Ray (EDWRR), and World Kitchen, LLC ("Sponsors") and/or their affiliated or subsidiary companies are not eligible to participate. Contest is subject to the laws of the USA, including all federal, state and local laws and regulations and is void where prohibited by law. One entry per person. 2. How To Enter: Contest begins 12:01 A.M. EST September 4, 2008 and ends on October 30, 2008. All entries must be made online and must be received by 11:59 P.M. EST on October 30, 2008. To enter visit chatandchew.rachaelraymag.com and follow the instructions. Online or onsite entries submitted from geographic areas in which residents are not eligible will be disqualified. If entries do not contain all necessary information, entrants will be disqualified. Please be certain to follow all directions. The Submission must be the original work of entrant and not previously published. Submission must not infringe any patent, copyright, trademark, trade secret, privacy, publicity or other intellectual property rights of any person or entity. All entries become the property of Sponsor(s) or their designee and will not be returned. By entering the Contest, participants agree that, if their recipes are chosen as winning recipes, they will grant to Sponsor(s) or their designee all right, title and interest in such winning recipe, including the right to use such winning recipe in all print and electronic media, and to edit it for brevity and clarity. 3. Judging: SUBMIT YOUR FAVORITE RECIPE USING ANY CORNINGWARE® BAKEWARE AND/OR CORELLE® SERVING PIECE AND AN Every Day with Rachael Ray COOKING EXPERT WILL RECIPE TEST AND JUDGE THE ENTRIES. The winner of the Contest will be determined by judging all the entrants' submissions based on the following criteria:Originality 25%, Ease of preparation 25%, Adherence to the contest theme (use of CorningWare® bakeware and/or a Corelle® serving piece) 25%, and Taste 25%. All entries will be judged using the criteria stated above. Decision of the judges is final and binding on all matters relating to this contest. One grand prize winner and 5 runners-up will be selected. Submit an original "Nice Serve" recipe. A "Nice Serve" recipe is defined as a recipe that is made using CorningWare® bakeware and/or a Corelle® serving piece. Each recipe must be original, created by the entrant, and must not have previously been published nor won a prize or award. Recipes must have no more than ten (10) ingredients, including any garnishes, salt and pepper. All ingredients must be listed together with exact measurements on the entry form. Complete preparation instructions must be provided on the entry form, including specific types and sizes of any required cooking equipment, cooking times and tests to determine whether food is ready. Recipe must be able to be completely prepared and served in no more than one hour. 4. Prizes: The Grand Prize Winner will receive a 3-day, 2-night trip for two to New York City, including airfare and hotel accommodations, and while in New York City will receive a tour of the Every Day with Rachael Ray test kitchen. Trip Specifics: Winner will receive round trip economy class airfare for winner and one guest from an airport closest to Winner's home to a New York airport, hotel accommodations for 2 nights for 2 people in one standard double occupancy room at a hotel of Sponsors' choosing. Winner is responsible for transportation to and from airports of departure/arrival and transfers from airport to hotel. Grand Prize Winner and Guest must travel on same itinerary. Should the Grand Prize Winner elect to not take a guest, or such guest is unable to accompany Grand Prize Winner on same itinerary, Grand Prize Winner shall forfeit that portion of the Grand Prize and the difference between the actual value of the Grand Prize and the stated ARV will not be awarded. Grand Prize Winner's travel guest must be 21 years of age or older or the spouse, child or legal ward of the Grand Prize Winner. Five (5) runners up will receive a Corelle®/CorningWare® and Every Day with Rachael Ray gift basket consisting of Corelle®/CorningWare® products and a three-piece Rachael Ray Spoonula Set. The Total Approximate Retail Value (ARV) of the Grand Prize is $2,500 and the Total Approximate Retail Value (ARV) of the runner up Gift Baskets is $100 each ($3,000 in total prizes). The prizes are not transferable and cannot be assigned, substituted or redeemed for cash. Acceptance of delivery of the prizes, including travel for the Grand Prize, must be completed within three months after the relevant winner is notified, and the specific date will be subject to availability and Sponsor(s) discretion. No transfer, assignment or substitution of prize permitted, except Sponsor(s) reserve the right to substitute a similar prize of equal or greater value in the event that the stated prize is no longer available/cannot be awarded due to circumstances beyond the control of the Sponsor(s). All expenses not specified herein are the sole responsibility of the Grand Prize Winner and his/her travel Guest including, without limitation meals, mini-bar, gratuities, telephone calls, and pre/post hotel accommodations. All taxes, if any are the sole responsibility of the winner(s), as well as travel risks, insurance, loss or damage due to prize acceptance or use. Neither the Sponsor(s) nor their affiliates nor subsidiaries will be responsible for any loss, liability or damage arising out of a winner's acceptance or use of a prize. The Grand Prize Winner and his/her travel guest may wish to obtain travel insurance (or other forms of insurance) at their own expense and hereby acknowledge that the Sponsor(s) have not and will not obtain or provide travel insurance or any other form of insurance. The Grand Prize Winner and his/her travel guest must possess valid travel documents in order to travel. All prizes will be awarded. 5. Selection of Winner: Winners will be selected on or about November 27, 2008 and notified by regular mail, and those with known email addresses may be notified by email as well, all within 30 days of selection. Winners may be required to execute a Statement of Eligibility and Release, Payment Authorization and Media Use Release within 30 days of prize notification attempt or the relevant winner will be disqualified and the relevant prize may be awarded to an alternate winner. Return of prize or prize notification as undeliverable will result in disqualification and an alternate winner may be selected. Entry and/or acceptance of prize(s) constitutes permission for the Sponsor(s) and their agencies (if any) to use the winner's name, address (city and state) and/or likeness for advertising and trade purposes without further compensation or authorization, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, unless prohibited by law. 6. Conditions: Sponsor(s) are not liable for any technical malfunctions of any telephone network or lines, computer internet system, servers or providers, computer equipment, software, failure of any email on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading/uploading any materials in this Contest, or other technical difficulties or failures or other errors of any kind. Sponsor(s) are not responsible or liable for any injury or damage to an entrant's or third person's computer and/or its contents, related to or resulting from Contest. Sponsor(s) reserve the right to terminate or modify the Contest at any time for any reason. In such a circumstance, winners will be selected based on entries received to date of termination. In the event that two similar entries are received, only the entry judged to best meet criteria set forth in Paragraph 3, above, will be included in the final judging. Entrants agree to release and indemnify Sponsor(s), their affiliated and subsidiary companies from and against any and all claims and liabilities arising out of or in connection with this Contest. False or deceptive entries or acts will render the Entrant ineligible. Sponsor(s), in their sole discretion, reserve the immediate and unrestricted right to disqualify any entrant or prize winner, if either commits or has committed any act, or has been involved or becomes involved in any situation or occurrence which the Sponsor(s) deem likely to subject the Sponsor(s), entrant or winner to ridicule, scandal or contempt or which reflects unfavorably upon the Sponsor(s) in any way. If such information is discovered by Sponsor(s) after a winner has received notice of his prize and before the prize is awarded, Sponsor(s) may rescind the prize in its entirety. If a portion of his/her prize has already been awarded, Sponsor(s) may withdraw the remainder of the prize that has not been fulfilled. Any dispute regarding submission of online entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organizations (e.g. business, educational institute) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor(s), in their sole discretion, reserve the right to disqualify any person tampering with the operation of the website or the entry process. Decisions of the Sponsor(s) are final and binding in all matters related to this paragraph. Sponsor(s) are not responsible for any typographical or other error in the printing of the offer, administration of the Contest, or in the announcement of the winners and prizes. 7. General Release: By entering the Contest, the participants release Sponsor(s) and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or acceptance, possession, or use of any element of a prize package (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Each participant understands and, by entering and, as a winner, accepting a prize, agrees that the prizes, including the Grand Prize travel package feature an inherent risk of injury (or even death) and he/she and, if the Grand Prize Winner, his/her traveling companion will each expressly agree to release Released Parties from and assume themselves all risks related thereto. Each participants, by entering and, as a winner, accepting a prize, further agrees to sign and, if the Grand Prize Winner, to arrange for his/her travel guest to sign, and return, upon request of Sponsor(s) and within the time specified by Sponsor(s), all written releases and additional documentation furnished by the Sponsor(s) and/or a prize supplier, for any component of the prize that may be required in conjunction with acceptance thereof. If a designated winner fails to comply with the foregoing requirements of this paragraph, such designated winner will forfeit the relevant prize and an alternate winner will be selected by the judges from among the remaining eligible entries received, based on the criteria set forth in paragraph 3, above. 8. GOVERNING LAW: By entering this Contest each participant agrees that this Contest is governed by the internal laws of the state of New York without regard to principals of conflict of laws and that all cases and claims pertaining to this Contest must be brought in a court of competent jurisdiction in the City of New York, without recourse to class action suits. 9. SEVERABILITY: If any provision of these Rules is found to be invalid or unenforceable by a court of competent jurisdiction or appointed arbitrator, such determination shall in no way affect the validity or enforceability of any other provision herein. 10. The total number of contestants anticipated nationwide is 15,000. 11.
